What is a Code Amendment and why is it needed?

The Code is the rulebook for how land can be used, divided and developed, including how places with heritage value are protected across South Australia.

In the Code, when a property is listed as a local heritage place, the Local Heritage Place Overlay will apply. This Overlay contains specific policies to ensure that any development, renovation, or use of the land conserves its heritage value and cultural significance. A key feature of the Overlay is demolition control, which restricts the demolition of local heritage places unless they meet strict criteria.

Properties that neighbour a Local Heritage Place may have a Heritage Adjacency Overlay applied. Future development proposed on neighbouring properties will be assessed to ensure it does not unreasonably impact the heritage values or setting of the local heritage place.

The Beachport Local Heritage Code Amendment is a proposed change to the Planning and Design Code to help protect places of local heritage significance within Beachport.

The proposed amendment follows a review and survey of the Beachport community which began in 2016. The review was undertaken in partnership with the Beachport Local Heritage Committee, which was established to identify places of local heritage significance in Beachport. 19 places were considered to satisfy the relevant criteria under the Planning, Development and Infrastructure Act 2016 to warrant listing as Local Heritage Places.
