What is being decided?

Council is currently considering a proposal to close and sell to the adjoining landowner a portion of unmade road reserve located immediately adjacent to 6 Third Street, Hatherleigh, Hundred of Mount Muirhead. The formal process will be conducted pursuant to the provisions of the Roads (Opening & Closing) Act 1991.

Background

Council has received a request from a landholder seeking to purchase a portion of unmade road reserve located immediately adjacent to their property located at 6 Third Street, Hatherleigh. The proposal is to undertake a formal road closure of the unmade portion of Sixth Street, Hatherleigh (marked on the plan below) and merge with the adjoining land.

To enable Council to sell the road reserve, a formal process under the Roads (Opening and Closing) Act, 1991 is required to be undertaken.

Council considered the proposal at its meeting held 8 August 2023 and resolved to approve in principle the closure of the unmade road subject to several conditions including, public consultation being undertaken.

Next steps

A formal report will be prepared for consideration by Council and a decision made in relation to whether the formal road closure proposal is supported or not.
