Proposed Community Land Revocation - Saleyards Road Millicent
What is being decided?
Council is seeking feedback on a proposal to revoke the community land classification over a portion of Council-owned land located at Allotment 2, Saleyards Road, Millicent.
Background
Council at its meeting held on 11 February 2025 considered a report to revoke the community land classification over a portion of Allotment 2, Saleyards Road, Millicent, as contained in Certificate of Title Volume 5165 Folio 329 (Subject Land) (area marked in blue below).

The Subject Land consists of a mix of land used for Council’s quarrying operations and vacant farming land which had been utilised in conjunction with the adjoining former Millicent Saleyards facility.
The Subject Land does not fit the current use and Community Land classification for the remainder of the land. In order to correct the land use anomaly, Council proposes to revoke the Community Land classification from the Subject Land and undertake a boundary realignment of two distinct portions of the Subject Land to the adjoining freehold Council Land.
The lower section of this land would be amalgamated with the adjoining quarry lands owned by the Council, to be retained for operational purposes.

The upper section would be amalgamated with the former Millicent Saleyards Precinct, also owned by the Council with the intention of either retaining, leasing, or selling the surplus land through an Expression of Interest process. The purpose for this would be to enhance opportunities for economic development of this precinct to the benefit of the greater community.
As the land is classified as community land, in order to undertake the boundary realignment, the Community Land status must be removed through a process as outlined in Section 194(2) of the Local Government Act 1999. This process includes undertaking public consultation and seeking approval to revoke the status from the Minister for Local Government.
